Civic issues
Topics getting the most attention in Benicia public meetings, ranked by how frequently they come up.
Data center zoning regulations
With no data center rules on the books since 1987, any facility could have opened in the industrial park by right. The new ordinance requires public hearings and use permits for every data center, caps them at 20 megawatts, bans diesel backup generators, and mandates water conservation. Second reading and adoption is set for October 27.
Residential expansion compatibility in the Downtown Historic District
The redesign of a house addition at 469 West J Street shows how new construction in Benicia's historic district gets weighed against neighborhood character. The applicant scaled the project back significantly after neighbor pushback, and the commission approved it with conditions protecting a street tree and an old retaining wall.
Right-of-Way Vacation at 650 East N Street
A property owner gets 250 square feet of unused street strip — five feet by 50 feet — so they can build two accessory dwelling units. The city keeps more than 20 feet of right-of-way beyond the sidewalk, and the land must be sold to the owner at appraised value.
Zoning Amendments for Commercial Recreation and Outdoor Food Service
Staff proposed allowing indoor commercial recreation (sports training, archery, shooting galleries) on about 26 acres along Goodyear Road and Gateway Plaza Drive, and outdoor food service in the mixed-use infill zone. Council balked over shooting galleries with live ammunition, pickleball, and the $7,000 conditional use permit requirement, and sent it back to staff.
Housing Accountability Act and builder's remedy
The applicant is claiming 'builder's remedy' status under state housing law, which limits the city's power to deny housing projects — even ones that don't match current zoning. The project must include 20% affordable units. It's a state law with real teeth.
Proposed Ordinance Amendments (BMC 8.55.090 and 8.55.220)
Staff wants to clean up two parts of the industrial safety ordinance: making facility reports cover the calendar year with a March 1 deadline, and locking fee rules (like the July 1 due date) into the code itself. The city council makes the final call.
Indoor commercial recreation in industrial zones
The city wants to let gyms, sports training, archery, and similar indoor recreation businesses open in the Limited Industrial district near Goodyear Road and Gateway Plaza Drive — fixing an oversight from 2025 zoning updates. This could bring new recreation businesses to Benicia.
Outdoor dining in the Mixed Use–Infill district
Restaurants and coffee shops near downtown — at Solano Square and along 5th Street and Military East — would get a formal path to offer outdoor seating, which several already do informally. This supports a more vibrant downtown edge.
